Z-Kids Terms of Use

In brief: a parent accepts these terms on the child's behalf. Z-Kids is licensed to play, not sold; virtual items have no real-world value; and purchases go through the app store, which is also where a refund starts.

Who is agreeing

These terms are between Z-SOFT CO., LTD (“Z-SOFT”, “we”, “us”) and the person who uses Z-Kids. Z-Kids is made for children, so the parent or legal guardian is the one who accepts: by installing a Z-Kids game or letting a child use one, you accept these terms on the child's behalf and take responsibility for that use. If you do not accept them, please do not install the game.

What Z-Kids is

Z-Kids is a platform of games and companion services for children, published by Z-SOFT CO., LTD, a software company registered in Da Nang, Vietnam. It is under active development: features arrive, change and occasionally leave.

Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play Z-Kids games on devices you or your child control, for personal, non-commercial entertainment. Everything else stays with us: the games, their code, artwork, characters, music, names and logos belong to Z-SOFT or to the partners who licensed them to us. Using Z-Kids in a classroom is welcome and needs no separate permission; charging admission to play it does.

House rules

Please do not:

• reverse engineer, decompile or modify a game, except to the extent the law expressly allows;
• cheat — bots, memory editors, modified builds or anything else that alters gameplay or fakes progress and purchases;
• attempt to reach accounts, servers or data you are not entitled to, or disrupt the service for other players;
• sell, trade or transfer an account, a nickname or virtual items outside the game;
• copy or redistribute the artwork, sounds, characters or code, or use them in another product;
• use Z-Kids commercially without our written permission.

Accounts and nicknames

Some games work entirely offline. Where a game offers an account, it is secured with a parent's email address, and the parent is responsible for keeping access to that mailbox. Choose a nickname that is not the child's real name; we may change a nickname that is offensive or that discloses personal information.

Purchases and virtual items

• Where a game offers a purchase, the payment is taken by the app store — Apple or Google — under their terms, not ours. We never see a card number.
• Please turn on the store's purchase authorisation (Ask to Buy, or a purchase password) before handing a device to a child. It is the single most effective control against an accidental purchase.
• Virtual currency and virtual items are a limited licence to use them inside the game. They are not property, they have no real-world value, they cannot be exchanged for money, and they cannot be transferred outside the game.
• A refund starts with the store that took the payment, because it is the only party that can issue one. Write to us as well and we will help where we can.
• If we ever retire a game that sold items, we will say so in the app at least 30 days beforehand and stop selling new items immediately.

Advertising

Z-Kids carries no third-party behavioural advertising. Where a game mentions another Z-SOFT game, it is our own promotion and is marked as such, and any link that leaves the app sits behind a parental gate.

Things a player makes

If a game lets a player create something — a drawing, a level, a character — whatever rights exist in it stay with the child, or with you as their parent. You give us the permission we need to store it, display it back in the game and back it up, and nothing more. Please do not put personal information into something a game may show to others. We may remove content that is unlawful, harmful or discloses personal information.

Updates, availability and changes

Games are updated, and an update may add, change or remove a feature. Some features need a working internet connection and will not be available without one. We do not guarantee that Z-Kids will be uninterrupted or error-free, and a server-based feature may be discontinued with reasonable notice.

Suspension and ending

We may suspend or close an account that breaks these rules, that is used to attack the service, or where we must do so by law — proportionately, and with an explanation unless the law prevents one. You may stop at any time by uninstalling the game, and you can ask us to delete the account and its data.

Playing sensibly

Take breaks. A very small number of people can have a seizure when exposed to flashing lights or patterns, even with no history of epilepsy — if a child experiences dizziness, altered vision, involuntary movements or disorientation while playing, stop and consult a doctor. How much screen time is right is a parent's decision, and we support the parental controls the operating system and the app stores provide.

No warranty

To the extent the law allows, Z-Kids is provided “as is”. We do not warrant that it will meet a particular expectation, that every device will run it well, or that it will always be available. This does not affect the rights a consumer has under the law of their own country, which we do not attempt to exclude.

Liability

To the extent the law allows, Z-SOFT is not liable for indirect or consequential loss, lost profit or lost data arising from the use of Z-Kids. Where a purchase was made, our total liability is limited to the amount paid for Z-Kids in the 12 months before the claim. Nothing here limits liability that cannot lawfully be limited — including for fraud, or for death or personal injury caused by negligence.

App stores and other services

Z-Kids is distributed through app stores that have their own terms and privacy policies, which apply to you alongside these terms. Where a game links to a service we do not run, we are not responsible for its content or its handling of your data.

Changes to these terms

We may update these terms; the date at the top shows when we last did. A material change is announced in the app before it takes effect, and continuing to use Z-Kids afterwards means you accept the updated version.

Governing law

These terms are governed by the laws of Vietnam. Disputes we cannot settle in good-faith discussion fall to the competent courts of Da Nang, Vietnam. If you are a consumer resident elsewhere, this does not remove the protection of the mandatory consumer law of the country you live in.
